Terms and Conditions of Use and Sale
The Bloom website (“Site”) is owned and operated by Sleep Country Canada Inc. (“the Company”) for your personal, non-commercial use. By accessing and browsing the Site, you agree to these Terms and Conditions of Use and Sale (the “Terms”) and all applicable laws. If you do not agree with any of these Terms, please do not use the Site.
The Company reserves the right to change, modify, add, or remove portions of these Terms at any time, without prior notice. We will notify you of such updates by posting them on the Site. Your continued use of the Site following such updates indicates your acceptance of the new Terms.
1. Use of the Site
The Site and its content are intended for use by customers residing in Canada only. You are responsible for ensuring that accessing the Site complies with the laws of your jurisdiction. The products and services available on the Site are not intended for distribution or use outside of Canada.
2. Acceptable Use Policy
By using the Site, you agree to:
• Use the Site only for lawful purposes
• Respect our intellectual property rights
• Provide accurate information when creating accounts or placing orders
• Refrain from interfering with the Site’s operation (e.g., through hacking or spreading malware)

4. No Use by Minors
The Site is intended for adult use only. If you are under the age of majority in your province or territory, a parent or guardian must make purchases on your behalf. Bloom does not knowingly collect information from children under the age of 13.
5. Product Purchases and Account Security
When purchasing Bloom products through the Site, you are responsible for:
• Maintaining the confidentiality of your account and password
• All activities conducted under your account
• Providing accurate billing and shipping information
The Company reserves the right to refuse service, cancel orders, or terminate accounts at its sole discretion.
6. Product Information and Availability
Products on the Site are available for sale to customers in Canada only. While we strive to provide accurate descriptions, we cannot guarantee that the Site is free from errors. Product availability may vary, and we reserve the right to update or discontinue products at any time without notice.
If a product is unavailable after you place an order, we will notify you and cancel your order unless you agree to a revised delivery schedule.
7. Pricing and Orders
All prices are listed in Canadian dollars (CAD) and do not include taxes or shipping fees unless otherwise stated. Prices and product availability are subject to change without notice.
You will receive an Order Confirmation summarizing your purchase, including product details, pricing, taxes, and shipping costs. An order becomes binding only when the Company confirms it by email. If pricing errors occur, we reserve the right to cancel or adjust your order, even after payment has been processed.
8. Payment and Shipping
We accept payment by:

• PayPal
• Affirm financing options
All payments must be approved by the issuing financial institution. Orders will be shipped based on your selected delivery option. Delivery times are estimates only, and we are not liable for any delays beyond our control. Some regions may incur additional shipping fees.
9. Risk of Loss
Ownership and risk of loss transfer to you upon delivery of the product to the third-party carrier. We are not responsible for any loss or damage that occurs after the product has been handed over for delivery.
10. Returns and Warranty
Bloom offers a 100-night comfort guarantee on all mattresses. If you are not satisfied with your product, you can exchange it within 100 days of delivery. Returned products must be in good condition, accompanied by proof of purchase.
Products are covered by a 10-year warranty, except the Bloom River mattress, which has a 5-year warranty. See our Returns Policy and Warranty page for full details.
11. Limitation of Liability
The Site and all products are provided on an “as-is” and “as-available” basis. Bloom makes no guarantees regarding the Site’s operation or product availability.
To the extent permitted by law, we are not responsible for:
• Errors on the Site or interruptions in service
• Delivery delays or issues beyond our control
• Loss of data, profits, or business opportunities due to your use of the Site
Our liability for any claim related to your use of the Site or our products is limited to the amount paid for the product in question.
12. Intellectual Property
All content on the Site, including text, images, logos, and videos, is the property of Bloom or its licensors and is protected by copyright laws. You may not copy, distribute, or modify any content without prior written permission from Bloom.
13. Cancellation
We reserve the right to cancel any order at our discretion, even after confirmation. If your order is cancelled, we will notify you and issue a full refund for any payments made.
14. Electronic Communication Consent
By using the Site, you consent to receive communications from us electronically. These communications, including order confirmations, satisfy any legal requirement for written communication.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes will be resolved in the courts of Ontario. By using the Site, you agree to submit to the exclusive jurisdiction of these courts.
16. Modification of the Site
We reserve the right to modify, suspend, or discontinue the Site or any of its features without notice. We are not responsible for any consequences resulting from such changes.
17. Entire Agreement
These Terms, together with our Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and Bloom regarding your use of the Site.
